GENERAL TERMS OF USE

Fundación Banco Santander (hereinafter, "The Foundation") whose tax identification number is G-80576200, is the entity responsible for the contents and management of this website (hereinafter, "the Site"). The Foundation is registered in the Registry of Foundations of the Ministry of Justice under number 208, with registered office in Calle Serrano, number 57, Madrid.

Please read the following general conditions carefully. Access to and/or use of the Site is purely voluntary, conferring on the person using the site the status of user (hereinafter "User", or in the plural form "Users"). All Users, whether or not they are registered as such, agree, from the moment they access the Site, without any reservations, to the contents of these General Terms of Use.

1. PURPOSE AND MODIFICATION OF TERMS
   The Foundation has developed the Site in order to disseminate its sponsorship work in the three areas it currently works in: culture, environment and social action. The three lines are based on common principles of action: innovation as a tool for change, education as a motor for progress in society and support for fragile and vulnerable groups as a formula for inclusion. Via the Site, the Foundation not only disseminates its activities but also promotes access to its grants through open calls for proposals in order to ensure that everyone participates equally in its programmes.
   The Foundation offers Users the possibility of browsing and accessing the contents and services of the Site, provided that they do so in accordance with the provisions of this Legal Notice.
   On the Site, Users may register and participate in the different programmes offered, for which they will have to meet the requirements established in each case. Users may also subscribe to the Foundation's newsletter by completing the registration form provided on the Site.
   In any case, the Foundation reserves the right, at any time and without prior notice, to modify or eliminate the content, structure, design, services and conditions of access and/or use of this Site, whenever it is deemed appropriate, as well as to make as many modifications to this Legal Notice as it deems appropriate, in which case the Users will be previously informed. These modifications will be valid from the moment they are published on the Site.
    
2. RESPONSIBILITY OF THE USER
   By way of illustration, but not limited to the following aspects, the User is responsible for:
   1- Registering or communicating data that is true, accurate, complete and/or up to date. The User must not access the Site using the name, identification data or password of another User or impersonate any other person or identity.
   2- The User is also obliged to use the services and contents provided by the Site in accordance with the legislation in force, the principles of good faith and generally accepted uses, and not to contravene public order or the provisions of this Legal Notice by their actions through the Site. In this regard, Users undertake to make lawful, diligent, honest and correct use of any information and/or content to which they have access through the Site.
   - any use for illicit purposes or that may damage or prevent, or overload, in any way, the use and normal operation of the Site, or that directly or indirectly threatens the Site or any third party.
   - using the Site for fraudulent purposes, or related to criminal offences or illegal activities of any kind.
   - introducing or spreading computer viruses that may cause unauthorised alterations to the contents or systems of the Site.
   - creating a Profile or using the Site to send, use or re-use material that is illegal, offensive, pornographic, abusive, indecent, defamatory, obscene or threatening in any way, or that infringes on copyright, trademark or confidentiality, privacy or any other rights, or is otherwise injurious or objectionable to third parties.
   - sending or otherwise distributing content that may violate any legislation in force or that may infringe any right of any party.
   The Foundation reserves the right to deny any attempt to access the Site and/or to cancel accounts in cases where the Site is used incorrectly, or when any of the stipulations established in this Legal Notice or those of private individuals are not complied with.
   In accordance with the provisions of the "Intellectual and Industrial Property Rights" clause, the reproduction, distribution, transmission, adaptation or modification, by any means and in any form, of the contents of the Site (texts, designs, graphics, information, databases, sound and/or image files, logos,...) and other elements of this site is prohibited, except when previous authorisation is obtained by the legitimate owners or when permitted by law.
   Likewise, any commercial or advertising use, other than that which is strictly permitted, and the violation, in general, of any right derived from the contents detailed above, is prohibited.
   The User shall be solely responsible for the use of the Site and for compliance with this Legal Notice in its entirety. Consequently, the User is obliged to maintain the confidentiality of his/her access codes, passwords or similar data assigned to access the Site or any of its services, being responsible for any damages of any nature derived from the improper use made by him/her or by third parties, both against the User himself/herself, considering the damages he/she suffers as a result of his/her negligence, as well as those that the Foundation may suffer as a result of the breach of this Legal Notice.
   Any infringement of this Legal Notice may give rise to the corresponding civil or criminal out-of-court or legal proceedings against the User, who must hold the Foundation harmless against any claims, demands, damages and losses that he/she may suffer as a result of such an infringement.
    
3. RESPONSIBILITY AND GUARANTEE OFFERED BY FUNDACIÓN BANCO SANTANDER
   The Foundation has obtained the information and materials included in the Site from sources considered to be reliable, however, while reasonable steps have been taken to ensure that the Information contained is correct, the Foundation does not guarantee that it is accurate, complete, or up-to-date and, consequently, it should not be relied upon as if it were. The Foundation expressly declines any responsibility for error or omission in the Information contained in the Site and reserves the right to modify, suspend, cancel or restrict the content of the Site, the links or the information obtained through it, without prior notice.
   The Foundation does not assume any responsibility for the activities or conduct of the Users. Nothing in this Site should be considered as a sponsorship or guarantee in relation to a User or third parties, whether in relation to their websites, products, services, or in any other way.
   Under no circumstances will the Foundation, and/or its patrons, directors, employees and authorised personnel be responsible for any type of damage, loss, claim or expense of any kind, whether or not they arise from the use of the Site, the information acquired or accessed by or through it, computer viruses, operational failures or interruptions in the service or transmission, or failures in the connection; the use of the Site, whether by direct connection or by link or other means, constitutes a warning to any user that these possibilities may occur.
   It is forbidden to transfer or send through the Site any illegal or illicit content, computer virus, or messages that, in general, affect or violate the rights of the Foundation or third parties.
   The Foundation is not responsible for the websites that are not its own and which can be accessed through links or any content made available by third parties. Any use of a link or access to a website not belonging to the Foundation is made at the exclusive will and risk of the User. The Foundation does not recommend or guarantee any information obtained by or through a link, nor is it responsible for any loss, claim or damage derived from the use or misuse of a link, or of the information obtained through it, including other links or websites, for the interruption in the service or access, or the attempt to use or misuse a link, both when accessing the Site, and when accessing the information of other websites from the Site.
    
4. LINKS
   Within its contents, the Site includes links to websites belonging to and/or managed by third parties in order to facilitate access to information and services available on the Internet.
   The Foundation does not assume any responsibility derived from the existence of links between the contents of the Site and contents located outside of the same or any other mention of contents external to this site. Such links or mentions have an exclusively informative purpose and, in no case, imply the support, approval, commercialisation or any relation between the Foundation and the persons or entities that are authors and/or managers of such contents or owners of the websites where they are located.
   In this sense, the User undertakes to exercise maximum diligence and prudence when accessing or using the content or services of the sites accessed by virtue of the aforementioned links. .
   
   
5. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
   This Site is owned by the Foundation. The intellectual and industrial property rights and the rights to use and reproduce this Site, its pages, screens, the information they contain, their appearance, structure and design, audio files and software, as well as the links ("hyperlinks") that may be established from the Site to other websites of any company belonging to Grupo Santander, are the property of, have been assigned to or are the subject of a licence in favour of the Foundation.
   All the names, designs and/or logos that make up this page are duly registered trademarks. Likewise, all the rights over the content, webiste source code, and, especially, but not limited to, all the rights over the photographs, images, texts, databases, logos, structure, brands and other elements, commercial names, data included in the Site and any other rights of the Site are protected by the laws and international treaties on intellectual and industrial property. Any improper use of the same by a person other than its legitimate owner may be prosecuted in accordance with current legislation.
   The reproduction, transmission, adaptation, translation, modification, distribution, or public communication, including making available, of all or part of the contents of the Site, in any other means of all or part of the information, content and warnings of this Site is expressly forbidden unless prior and express authorisation is granted in writing by the Foundation. Any infringement of these rights may give rise to the corresponding civil or criminal out-of-court or legal proceedings by the Foundation.
   The Foundation does not grant any license or authorization of use of any kind on its intellectual and industrial property rights, or on any other property or right related to the Site, the services or the contents of the same, and in no case shall it be understood that access and navigation by Users implies a waiver, transmission, license or total or partial assignment of such rights by the Foundation.
   Any use of these contents not previously authorised by the Foundation will be considered a serious breach of the intellectual or industrial property rights and will give rise to the legally established responsibilities.
   The legitimacy of the intellectual or industrial property rights corresponding to the contents provided by third parties is the exclusive responsibility of the same.
   In order to preserve any possible intellectual and industrial property rights, in the event that any User or third party considers that their legitimate rights have been violated by the introduction of a certain content in the Site, they must notify this circumstance, in writing, to FUNDACIÓN BANCO SANTANDER, calle Serrano, number 57, 28006, Madrid, indicating:
   - Personal data identifying the interested party who is the owner of the allegedly infringed rights. If the claim is presented by a third party other than the interested party, he/she must indicate the representation with which he/she is acting.
   - Indication of the contents protected by intellectual property rights and their location in the Site.
   - Accreditation of the existence, ownership and validity of the aforementioned intellectual property rights.
   - Express declaration in which the interested party takes responsibility for the veracity of the data and information provided in the notification referred to in this point.
   
   
6. PROTECTION OF PERSONAL DATA
   The Foundation fully complies with the regulations on the protection of personal data and, in particular, with the REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as "GDPR"), so that the processing of personal information provided by the User when registering for the various programmes offered through the Site or when subscribing to the Foundation's newsletter, will be carried out in compliance with the applicable legal guarantees and obligations.
   Users will be able to know the applicable Data Protection Policy prior to their application to register in any programme offered by the Foundation or applicable to the subscription to the Foundation's newsletter. The Foundation will make the applicable Data Protection Policy available to Users, in compliance with the duty of information, so that Users are aware of all information relating to the processing of their personal data, as stipulated by the GDPR.
   In accordance with current regulations, Users are informed that the Foundation has implemented the appropriate technical and organisational measures to guarantee an adequate level of security, as well as to prevent the loss, misuse, alteration, unauthorised access and theft of the data provided by the User. In the same manner, the Foundation guarantees that it complies with the duty of secrecy and confidentiality regarding the personal data provided by the User through the Site.

7. LOSS OF USER STATUS
   The registered Users may cancel their registration, losing their status as such, and the rights and data associated with their account, freely and at any time, in relation to the newsletter of their choice by clicking on the cancellation option in the footer.
   The loss of the status of User does not exclude the application of this Legal Notice, which will continue to be applicable to any questions or claims that may arise between the Foundation and the User, after the latter has lost the status of User.
   
   
8. APPLICABLE LAW AND JURISDICTION
   This Legal Notice shall be governed by Spanish law.
   The Foundation and the User are subject to the jurisdiction of the Courts and Tribunals of the city of Madrid for any issues that may arise or actions that may be taken as a result of the services and contents of the Site, as well as the interpretation, application, compliance or non-compliance with the provisions of these general conditions.
